The Curaçao Gaming License: The LOK Overhaul and Direct Regulation
For almost three decades, the Curaçao iGaming license was notorious for its structural loopholes. Under the legacy National Ordinance on Offshore Games of Hazard (NOOGH), four private master license holders (such as Antillephone N.V. and Gaming Curacao) operated as regulatory middlemen, issuing sublicenses with minimal oversight. That era is permanently over. The implementation of the Landsverordening op de Kansspelen (LOK) in late 2024 fundamentally dismantled the master license system, transforming Curaçao into a directly regulated jurisdiction managed exclusively by the Curaçao Gaming Authority (CGA).
The End of the Sublicense Era: What Actually Changed?
The LOK legislation did not merely update administrative fees; it rebuilt the jurisdiction’s compliance architecture from the ground up to align with international FATF (Financial Action Task Force) standards. Operators attempting to leverage Curaçao as an anonymous offshore haven now face immediate regulatory friction:
Direct CGA Licensing: The private master licenses were officially abolished on January 1, 2025. Today, both B2C operators (sportsbooks, casinos) and B2B suppliers (studios, payment processors) must apply directly to the CGA via the government’s official License Management Portal.
Strict AML and KYC Enforcement: The old regime’s lax verification standards have been replaced by mandatory Risk-Based Approach (RBA) frameworks. Operators must implement live transaction monitoring, report suspicious activities directly to the Curaçao FIU via the goAML system, and conduct Enhanced Due Diligence (EDD) for crypto depositors and players from high-risk jurisdictions.
The Dedicated Compliance Officer: The CGA now requires every licensee to appoint a verified, independent Compliance Officer whose sole responsibility is managing AML protocols, player protection frameworks, and regulatory reporting.
The 2026 Local Substance Mandate
The most significant operational hurdle for modern offshore bookmakers is the physical presence rule. Historically, a Curaçao company could exist entirely as a virtual mailbox. However, as of January 1, 2026, the LOK enforces strict corporate substance requirements:
Resident Directors: Every licensed entity must have at least one managing director who is a legal resident of Curaçao, or rely on a local corporate management entity that possesses resident directors.
Physical Office Space: Virtual offices no longer satisfy the regulator. Licensees must maintain verifiable, physical commercial premises on the island.
Local Employment Escalation: To satisfy Article 5.12 of the LOK (enforced starting in 2027), operators must begin recruiting Key Persons directly from the local Curaçao Population Register.
B2C vs. B2B Segregation
The new framework formally separates the supply chain. A B2C Gaming License covers player-facing domains, while software aggregators, game developers, and odds feed providers must secure a distinct B2B Supplier License by December 2026. This ensures that every node in the iGaming ecosystem—from the payment gateway to the RNG server—is accountable to the Ministry of Justice. For sports bettors, a verified CGA license (checked directly on the official portal) now guarantees a baseline level of capital security and dispute resolution that simply did not exist under the defunct sublicense model.
